Court clarifies reimbursement obligation in personal injuries actions – Fahy v Padraic Fahy Tiling Contractors Ltd & Anor

In a recent High Court case before Justice Twomey, the Court was posed with the question of whether or not a settlement agreement negotiated outside of court can remove the obligation on a Defendant to reimburse the Department of Social Welfare. While this question had been answered in the negative by the Court on a previous occasion, the current case looked to answer whether the situation might be different if one of the Defendants is a State Body
